Background

The UK’s Digital Markets, Competition and Consumers Act 2024 (DMCCA) bans fake or misleading reviews that could influence a consumer’s decision to purchase a product or service (or to avoid such a purchase). In connection with this rule the DMCCA requires organisations who use, display or benefit from consumer reviews to adopt an anti-fake review policy. This is EM Law’s anti-fake review policy.

Who can submit a review

We welcome reviews from individuals and organisations who we have supported through the delivery of our services.

We don’t incentivise reviews

We don’t offer any incentives for positive reviews.

How to leave a review

You can leave a review by either emailing it to us or by uploading your review to EM Law’s business profile on Google.

You can amend or delete any reviews that appear on our website’s testimonials page by emailing us your request which we will action as soon as we receive it. You can amend or delete your review on our business profile on Google by logging into your Google account and updating your reviews page.

Rules for reviews

Your review must:

  • Reflect your genuine experience (both positives and negatives).
  • Not be incentivised in any way.
  • Not relate to a service you are connected with (for example, because you (or someone in your family) has a financial interest in or works for the business that provides it).
  • Not manipulate ratings (for example, you cannot submit multiple reviews for the same service).
  • Comply with our Acceptable Use policy, for example it must not be obscene, offensive, harmful or defamatory.
  • Not breach data protection laws.

We may use your reviews in our marketing

We may include all (or a representative part) of your review in our marketing material in any media (for example, on our website, in a brochure or in advertising).

Please report suspicious reviews to us or to Google

If you think any review is fake or otherwise doesn’t comply with the Rules for reviews please report this to us by emailing us at [email protected] or, if the report is on our Google business profile, you can report this to Google.

How we investigate and deal with suspicious reviews

If our own monitoring or a report from you or someone else suggests that a review does not comply with the Rules for reviews we will promptly investigate and may:

  • Remove it from our website or (if the review appears on our Google business profile) we will do what we can to remove it. We will do this where we are certain it is non-compliant.
  • Investigate it further (which may involve contacting the reviewer for evidence that it is compliant) and flag it as a possibly fake review until our investigation is complete. If we then determine the review is non-compliant we will remove it from our website or (if the review appears on our Google business profile) we will do what we can to remove it.

If we identify one review as non-compliant we may remove all reviews submitted by the same reviewer and refuse to publish any further reviews from the same reviewer.

Steps we may take where our services have attracted fake reviews include:

  • Warning consumers that our services have received fake reviews.
  • Notifying the Competition and Markets Authority if we consider the supplier is systematically breaching the law in relation to fake and misleading reviews.
